Head of the Servant of the People party, deputy head of the Verkhovna Rada Committee on State Power Organization, Local Self-Government, Regional Development and Urban Planning Olena Shulyak in a column for Interfax-Ukraine told, that urban planning control in Ukraine will act on the example of the British model and cited several advantages of adopting such experience.
Thus, according to her, draft law No. 5655, which is being prepared for the second reading, will introduce a mixed system of urban planning control, which operates in Great Britain. Participants of the construction market will have the opportunity to choose a body of urban planning control - representatives of local self-government bodies or representatives of private structures.
"In Ukraine, it is also proposed to create a consultative and advisory body under the relevant ministry - the Urban Planning Chamber. It will consist of 25 members — representatives of urban planning control bodies, the construction market, expert and self-regulatory organizations, etc. "Among the powers is consideration of cases and decision-making on the presence or absence of offenses, the responsibility for which is established by the Law of Ukraine "On Regulation of Urban Development", Shulyak notes.
According to her, the public will have enhanced opportunities to control construction in communities. In turn, local authorities will be empowered to issue orders for the dismantling of illegal structures even without a court decision.
"It works similarly in the UK, as it does in many other democracies with strong and independent communities. Illegal constructions should be the responsibility of local authorities to their own communities," Shulyak notes.
She emphasized that with the adoption of draft law No. 5655, the construction industry will be one of the most digitized — as many services as possible will be provided online. The electronic system will automatically block the granting of permits if it detects violations in the design or in the examination of the project documentation.
It should be noted that the professional community recently criticized a number of provisions in the draft law and expressed concerns about the consequences of its adoption.
