"Urban rape". Resonant draft law No. 5655 was adopted, despite protests

Today, in the session hall of the VRU, a vote was held on draft law No. 5655 in the second reading. The authors of the draft law call it the cornerstone of the anti-corruption reform in urban planning, while opponents call it "urban planning rape."

People's deputies did not listen to the numerous calls to "vote with the red button" and cast 228 "yes" votes.

On the eve of the vote, dozens of representatives of the professional architectural community, city mayors, public activists published their appeals to the parliamentarians, urging them not to adopt a law that curtails the rights of citizens and representatives of local self-government, instead giving preferences to developers.

Previously, PRAGMATIKA.MEDIA repeatedly published materials devoted to the analysis of the draft law and the opinions of the parties. Today, we've collected a few quotes from recent appeals that ultimately went unheard.

Andrey Sadovy, the mayor of Lviv: "According to the proposed draft law, control functions will be given to a private inspection company. It can be created, for example, by the developer himself. Instead, representatives of the city council will not even have the right to enter the territory where construction is taking place. We are offered to manage the city, but our hands are tied."

Vitaly Klitschko, the mayor of Kyiv: "In fact, this is a draft law that completely eliminates city control over construction. And it creates the conditions for a monopoly, centralized admission of builders to the market. And those who enter will be allowed to create a private body to control urban planning activities without any influence of the state or local government!

Thus, arbitrary construction becomes fully legalized, violating the rights of both land owners and community residents."

Anna Bondar, architect, member of parliament: "The draft law contains more than 300 pages and 2000 pages of a comparative table. Written as a jeweler. Good lawyers, a systemic bill. There is only one question: what about your values?".

Anna Kyrii, architect, deputy head of the Architectural Chamber of NSAU: "Voting for 5655 is equal to voting for Kharkiv agreements and laws on January 16. We will remember your names.

I like that the story of 5655 reveals who is who. Everyone is visible: corrupt officials, criminals, profiteers, latent supporters, active, opportunistic, loyal to the authorities and those who remain silent, too."

Alina Mykhaylova, volunteer, serviceman of the Armed Forces of Ukraine: "The construction mafia, which focused on the interests of the community and the development of our cities, turned my beloved Kyiv almost into Shanghai. A high-rise building or a shopping center can appear in any park or even a lake, if the developer so desires and brings enough cash to the "decision centers".

The only safeguard is a civil society that does not tolerate this trash and actively uses the available tools. Tomorrow, these tools are going to be destroyed, and the construction industry will be completely handed over to the mafia.

We are talking about draft law 5655, the so-called "urban planning reform". It is presented under the guise of reconstruction, but in fact it is looting and opens the door to the embezzlement of funds intended for this same reconstruction."

Anton Tselovalnyk, architect, serviceman of the Armed Forces of Ukraine: "I am honored to be a part of the architectural community of Ukraine. I have the honor to serve my profession with dignity. I have the honor of being friends with many colleagues. I have the honor of being acquainted with several People's Deputies of Ukraine. I have a request not to vote for draft law No. 5655 and enter into a dialogue with the professional community. I believe in justice."

Yehor Shtefan, architect, serviceman of the Armed Forces of Ukraine: "I consider this law very harmful for Ukraine and Ukrainian cities. According to this law, the rights of architects, communities, and the city to influence architectural and engineering decisions in new buildings are significantly (!) reduced. At the same time, there are many opportunities to ignore any advice, corrections and comments from anyone in the owner/builder. It will turn our cities into monuments of greed, audacity and vanity."
